Who's Who in the Law on Protection of Consumers' Rights?


The Law on Protection of Consumers' quickly gained popularity and became one of the most used in Russia. Thousands of consumers with the law failed to protect their rights.
Who deems the consumer?
Consumer - the citizen, using, purchasing, ordering, or having the intention to buy or order goods (works, services) for household use, non-profit-making.
It should be noted that the consumer recognizes as a citizen, who had already purchased the goods (works or services) and uses it, and someone who is just going to do it. This means that, contact your dealer with a request to show you the goods and tell us about its properties, you are an existing customer. Seller's refusal in this situation may be regarded as a violation of the law.

The law says the consumer is not only a citizen who purchases the product (or service), but also someone who is directly in the product (service) uses. For example, the firm acquires its employees travel vouchers. In this case, employees of the company, the services, under the protection of the law "On consumer protection, although direct purchasers, they were not. Just protect the rights of persons to whom the goods or services were donated.
It should be noted that a citizen only if a consumer when he purchases goods (works, services) intended for household use. The term "household use" covers a very wide range of relations with citizens, and therefore these relations are regulated by law only when the goods (works, services) are purchased for personal use, non-profit-making.
Whom the law considers the entrepreneur
The other side of the relationship with consumers - it manufacturers, artists or vendors.
Manufacturer (vendor, performer) is an organization, regardless of ownership, as well as citizens, businesses that produce goods for sale to consumers, or sell them to consumers under contracts of sale.
The organization will be considered by the manufacturer only if it produces goods for sale to consumers. If the enterprise has no intention to sell manufactured goods to citizens, consumers, the laws on consumer protection it is not covered.
Seller, in accordance with the Law on Protection of Consumer Rights, is just an organization that sells consumer goods under a contract of sale, including interpretation. If the goods have been received in the organization in any other way, the norms of consumer legislation to the parties will not apply.
Performer, by law, is an organization that performs work or provides services to consumers on the basis of onerous contract. Payment for work performed (service) is the main criterion for the applicability of the law to one or another of the implementing agency.
